There are regs to a point but i think you may also find tow ball height can be set by vehicle manufacturer. Hence for example vans are particularly low to allow for doors opening and a low loading height.Do you have the direct link to that.
As per usual finding official docs is a complete mare.
I am sure that the 4x4 you think is an off road vehicle will be a road vehicle that can go off road.
The off road they mean will be vehicles that only or mostly go off road.
But I want to actually find the regs as this does come up a lot.

BIG list of conditions that must be complied with.
Cat N must be sub 2000kg MAM
Must have a diff lock
Clearance & Ramp / departure values must be in spec
30 degree climb
Cat N1 M1 25 degree climb if over 2000kg MAM
still needs diff lock & Clearance & Ramp / departure values in spec
