That's not really fair tbh. Leave the drivers alone. Regardless of what task they are doing they will be being paid crap agricultural wages. It should be the vehicle owner that always takes the wrap.
Same for most busines related vehicle offences. Bar obviously driving offenses I think the vehicle owner should be held responsible if they send a vehicle out without good enough load security kit, bald tyres and so on as we all know how pushy companies can be .

Utter bollox 🤬
it is the responsibility of the driver to ensure that the vehicle is fit for use, at the start of every shift before getting behind the wheel and reporting any/all defects found - end of!
if it's not fit for use it should not be used - end of!
the driver is responsible for all of this and ensuring he carries a load in compliance with the law - end of! ...
if he is missing any equipment to comply, he should not be getting behind the wheel - end of !! ....

WTF shouldn't he be held responsible for not giving a sh1t, regardless of what he's paid ...
he has a responsibility to operate within the law .. End of !!
if he killed one of your loved ones because of his negligent behaviour you'd be the first to hang him out to dry AND his boss with him

Yes he should have every right to refuse but the punishment should be on the operator. It is the only way to actually stop the problems. Currently there are far far to many bullyish companies operating knowing that there slap dash attitude will ultimately be the drivers problem and the the majority of people are not in the position to change jobs at short notice.

And this shows no sign of changing as the companies know they can get away with it.
Certain parts of the industry are worse than others. On top of this atleast an hgv driver has CPC to try and educate them. The tractor driver if a young lad and only ever taught by the boss may well be completely ignorant of any wrong doing.

exactly ... or stand up to his responsibilities and refuse to use an unfit vehicle ..

neither is doing time

I don't think you realise the bullying attitude of alot of business druid. You have been very fortunate as are a lot on here to be in command of their own ship. Unfortunately what you forget is there are a lot of people in this country that are simply not in the position to stand up to there boss and equally as many people fully prepared to take advantage of this.

And by punishing the drivers you are doing nothing to stop these operators. If a driver refuses they will just find another.

" ignorantia juris non excusat ... ignorance is no defence in the eyes of the law"

it is the driver's responsibility to understand his legal obligations, when he takes to the road - end of !

It's like driving up the wrong side of a road/dual carriage way and saying they didn't know better ..
or the wrong way up a one way and saying they didn't understand what the sign meant ...
or driving an artic on a moped license

if you are on the road, you are legally obliged to know the law relating to what you are doing/driving .. there are no excuses for not knowing

Oh I do ... have worked for a few and stood my ground on more than one occasion

so you'd advocate doing time for an offence instead of dealing with it properly?
If I were dismissed by a belligerent boss, expecting me to risk my self for his benefit, my first port of call would be VOSA/DVSA and explain why to them. that's why they continue to be belligerent and behave the way they do - lack of accountability.
Plod who started this discussion off, should have done their jobs, not tickle the driver's wrists.

Can't agree. When it comes to being told to drive an agri vehicle for an agri purpose, the company is the one running bent and therefore the company is the one that should be punished- severely. I really can't see what you think we stand to gain from penalising the poor driver just doing what he's told.

whether you agree or not Doob, if driver's took their legal obligations seriously when on the roads then discussions like this would not be happening ... there are rules relating to 'agri use' which equally apply .... he wasn't pulled in a field FFS

The drivers deserve to have there licenses revoked..... End of... If a pikey jumped in a 18t lorry with nothing but a car license you'd be happy enough to see there license revoked. most of the 16yr old crowd are driving tractors too wide and heavy for there license anyway.

If the rules where actually enforced we might see farmers abit more keen to accept increased testing in exchange for uprated capacities and speeds.

I am saying it is a very hard place to be stood. I'm not saying keep working there indefinitely. But it takes time to find a new job. And nothing to say it's any better. There is a huge shortage of truck drivers in the UK and it's no surprise as it is a s**t system. And currently their is no incentive for the companies to stop bullying their staff into these situations.
The only other option would be a proper hgv drivers union but that has equally as many problems. So just punish the people who are making the decisions not those having the decisions made for them.

Truck drivers....no wonder there's a shortage ....heard lass behind me at hospital talking about her lad getting a new job as gate guy at big bypass project .. £16 an hour "all he does is open and close gates" .

Rory's bang on....from this crowing twitter post no where does it state the vehicle was thoroughly checked etc etc ..it was a "oh you no tarp" crack on lad style check imo.

New house building site been cleared this week...steady stream of nh and claas with dump trailers leaving ... seriously tell me that's all legit...
And yet if my cousin gets caught doing a favour with a couple of pallets on an empty run back from down south he's fkked. Htf can that be right.

A Farmer got sent down other day for a crash, he wasn’t driving but one of his employees was, his fastrac lost its brakes, crushed a car killer someone. Ran a haulage business along side so knew exactly what he was doing! Not sure what the driver got. Tractor hadn’t had full service in 6 years ffs 🤦

agreed but ... if these 'drivers' grew some and started dobbing these ar*e holes into DVSA , who could then nail them to the wall, things would change ... word would soon get around after DVSA prohibited a few from leaving their yards .. or simply impounded them the moment they set tyre on the black top
as long as these ppl ('drivers') continue to plead ignorance / ignore what they know to be wrong, it will be self perpetuating
we're not talking about HGVs here, but ppl running illegal ag type set ups, on work they know doesn't qualify, with rebated fuel, no VED, testing of equipment and cheapo spotty oik teens at the wheel (with possibly no idea) nor care, for their potential dangers. LGVs are seriously policed
