Long and simple it's a f****ng minefield.

Personally, I think if you hooked a duck up with a trailer to carry your attachments, had a plated drawbar weight and correct insurance you'd be fine, even if it went to court.

If you tried carrying some materials or soil you'd be crying out to be dragged over the coals.

Legally JCB jumped on the proverbial minefield, however there trailer was a "load carrier" as opposed to a Item of engineering plant to be used soley as a implement carrier for the towing vehicle.

With the change to white diesel you would have thought that if jcb start trying to get the rules changed again there would be less of a reason for the government to argue especially if the green agenda is pushed of having less machinery on site and less engines running.

Trouble is it very quickly runs into the minefield of a reality that our entire licensing system needs a shakeup.

I've no issue with lads getting Cat F at 16.... but a trundle round the roundabout isn't appropriate.... Nor is "your 18 have a car license, crack on with that digger" (What many don't know including plod is it's 18 for plant under 7.5t and 21 for anything heavier)

All needs a sort out..... but will never happen .

It's more than just the licensing. It's our governments determination to be green whilst simultaneously imposing old legislation that means inefficient working practices.

"The Vehicle Certification Agency (VCA) has confirmed, though, that the use of any earthmoving equipment to tow a trailer on the UK highway is not permitted, even if it is only used to transport attachments.

This is because a trailer carrying attachments cannot be defined as ‘Engineering Plant’, despite a generally held acceptance within the industry that it is."

It is worth remembering that the VCA work within frameworks and have very little actual power once something is on the Road, and the Category of "earthmoving equipment" doesn't exist. A Duck is most likely taxed as a "Digging Machine" - Specialist Vehicle Tax group. Which gives Unlimited Mileage on rebated fuel (Currently) but restricts you to carrying solely equipment for use by the machine in it's course of work.

If you Reclassed it as a Works truck, you loose the unlimited mileage element (you will do anyway come April) But you gain the ability to tow a trailer......

So from April we can tow a trailer but only for a limited mileage .

I'm still interested in this trailer argument . I'm seeing more and more ducks towing trailers locally. I've also read somewhere it is legal if you are carrying out road repairs. Anyone heard any further news other than from jcb ?
