The end of last week the stone and pipe land drains I laid in fields at beginning of the year have started to run again now but field is so much better for it as before it would be running on the surface by now and unusable
You might want to add some perforated pipe to your drainage channels to help with large deluge of wet stuff
Had contemplated it Stu, and there are pipes in the lower sections, up to circa half way up the patch ... but lacking in sensible depth in places further up, due to the bed rock at the channel bottoms and didn't want to go crushing the pipes, if I tracked onto 'em ..... TBH if there'd been pipes in there I don't think it'd have coped much better ...... the downpour was biblical and persistent, for hour after hour :oops: .
the main channel though the centre is 30" deep and 36"+ wide, full of clean 40mm ... terram on top, under the planings.... it copes 99% of the time :rolleyes:

they've had planning to replace that old building on the right for maybe 3 years ..... the white wall forms a boundary and is subject to the terms and provisions of the Party Wall Act, but does not straddle the boundary line....all on their side of it.
a week ago the building disappeared ... o_O

bearing in mind that, as said, this is subject to all the terms of the Party Wall Act, AND it retains my old drive ...

I'd had no notice this was happening ... minimum 2 months written required, to be accompanied by plans, RAMS, schedule of works, etc., etc.,etc., ... with a follow up written request for reasonable access two weeks before start date and could then only be commenced, assuming I had no objections, otherwise a 'dispute procedure' swings into place and everything stops.

I was not a happy bunny ... this is the numpty neighbour, who's tirade at Pam pissed us off 18 months ago and we've had ZERO contact with since, let alone any notifications, or requests necessary to comply with the PWA !!:rolleyes: He's just barged on regardless

Come back from town a couple of days later and my ****ing gate and R/h pillar has vanished into a n other skip and the builders are busy digging the side of my driveway out ..... Unhappy bunny does not come close .....

I had polite 'words' with the builder, who calmly tells me that he'd been told by Numpty that everything was fine and it had all been cleared with me :mad::mad::mad: .....

doing it was bad enough...lying to the ****ing builders was several steps beyond ... I was now within a gnats bollock of injunction time and shutting it down for 3 months.:mad::mad::mad::mad::mad:

I know the builder lads, who're a decent bunch and they're now not happy with all aspects of the situation ... particularly the prospect of no further work for several weeks to sort it. I am ****in' LIVID !! :mad:

Numpty won't even show his face out the house ... knows damned well he has fkd up .. BIG time !!
It's end of day, getting dark and I tell Wayne (the builder),we'll sort this in the morning ... after I've calmed down / de-stressed a bit ....
Wayne was left in no doubt he'd been lied to by Numpty, after he'd had the Party Wall Act's provisions and terms explained to him and went off home to have a read up.:rolleyes:

I like to think that I'm a reasonable man and had chilled a bit by the morning ... Wayne and I had a calm discussion about what had gone down and that the thing that ANNOYED ME MOST was the fact he'd been told bare faced lies and put in the position he was in ....
Numpty scuttled off and hid as soon as I appeared ..... which was probably for the best (y)..... one wrong word and it'd have been all stop ... arrogant bully that he is ... can't have a reasoned discussion with idiots like that.

Anyway .... having dug out my bloody driveway ...

clear demarcations were set as to build lines, boundaries, etc. and EXACTLY where the new wall is going to go, where faces are and where my ****ing gate pillar needs to be put, to replace the bugger they knocked down.

Asked him to fence off the drop to stop the kids or the cats taking a nose dive ... and to make sure we were both on the same song sheet from now on, before doing anything affecting me or my property ..

Wayne's fine ...... Numty's still hiding ... I'm not going looking for the tw*t ... don't need the stress and it'll only end one way, when he kicks off ... on stop !!

I hope he realizes that you have been very reasonable, and at the very least comes around and tries to make amends. The old man always says, don't fall out with the neighbors as they can make things very difficult (especially when your running a business) Thank fully we all get along pretty well!

Aiden you'll probably be able to recall, from CEF, the lengths I have gone to to help these people, since they came here, with all sorts of issues, efforts, weeks of free machine time, repairs and help, etc.
Others not so familiar won't know I have bent over backwards to be a good neighbour ... until 18 months ago when he well and truly shoved the bat up my arse, metaphorically speaking and all goodwill was withdrawn. They're the sort who can see no other way than their way/opinion and in their eyes, can do no wrong. :mad:

You're right ... good neighbours can make or break a happy environment in which to live/work/etc. ... We've just ignored them, as we're fortunate to not have to come into contact with them, if we so choose and gotten on with our lives ... the other neighbours are lovely people and I feel for them as they're in much closer proximity than us and have had their lives made a misery at times. The man is an arrogant, aggressive bully .... who can now add lying bastard to his title.

As you say I have been more than reasonable .. I doubt he has the intelligence to realise it, or the balls to admit his errors, to even try to make amends ..... it will take some doing after his behaviour of the last few weeks.

IMHDO he will maintain as low a profile as possible until the 'Sword of Damocles' is no longer looming overhead and then revert to type.
He knows full well he has absolutely contravened the PWA in every way possible, to say nothing of the criminal damage he has caused to my property and I could drop the axe/sword, at any point, if I chose to.

We shall see how it pans out ...... ATM I want something back in place to keep my drive way in situ .... Pronto:rolleyes:

Wayne the builder saved his bacon the other day, or he'd have been on the receiving end of a county court injunction by now and facing criminal damage charges !!
My solicitor is a barrister/QC, who just practices as a solicitor (easier life) :rolleyes:;) and has never failed me in 35+ years (y):):cool:

I'm in full agreement with you that he has failed miserably to comply with the PWA or to get any prior agreement with yourself. A word of caution however, and I'd certainly be checking with your solicitor asap. To my mind you're doing two things wrong here mate.
  1. You're sorting a replacement specification for the wall / boundary. In the eyes of the law you are now the person specifying the work. You've become the designer responsible for its specification and safety. More importantly you are giving up your rights to compensation or rights should dispute develop or arise at a later date. To this end Rory is right, better to slap them with a cease and desist now.
  2. Don't negotiate anything with the builder. He's a third party in all of this unless he has been formally authorized to act on behalf of the neighbour. You can agree anything you like with him, it has no legal standing and the neighbour can tell you both to sod off. More importantly it gives him every wriggle room to say I never agreed anything, It was Gra and Wayne who agreed this among themselves.
You're holding all the cards at the minute and are in a very strong position. Just make sure you're not giving any of this away being reasonable about the whole thing.

I'd agree here. Get the injunction and let Wayne deal with his client for damages for not sorting this stuff out. If your driveway slides, that's more damages that your neighbor has to pay for. End of they day, they need to have an expensive lesson.

thanks for the input guys ... I'm simply ensuring correct alignment here Nigel ... he has no right to build beyond the boundary line ... although termed as a 'party wall' it is entirely on his side of the boundary, not straddling it, but is still subject to the PWA terms. No foundations can straddle a boundary without prior agreement .
I'm not changing anything specification-wise ... simply ensuring non encroachment onto my property ... as is my right.
Having dug into my driveway a good foot plus, at the toe, the only sensible thing is to allow a full width pour to secure it IMHDO.

Yes you're both right, I should drop the axe instantly .... but I then have a vulnerable driveway, likely to succumb to the coming wet weather, with a possible 2-3 month delay on any further progress let alone getting my drive secured.... assuming the t**t continues afterward.

I may well have a word with Alun, my legal guy tomorrow, fill him in, prime him ready for some action and take his advice on the matter
