They wouldn't be able to take it back, would have to go to an authorised breaker yard
It wouldn't be the first cat b to slip the net and end up as a whole out of a breakers yard.
It's also not to say that who owned the truck previously is the one selling it because as you say they aren't available to buy back.

There was away round putting cat b back on the road but that's a story for a different day and was a complex loophole hence why it was only worth it with really high end motors.

If you had an accident pulling your digger where someone ran into the back of you and the insurance refused to pay out because you were a hundred kg overweight would you be happy?
No but as far as I’m aware they can just say you’re uninsured if you are breaking the conditions of your license?

Insurance industry works in different ways with liabilities.

If its been rear ended, over loaded or not, the liability will most like be with the one that's driven into it.

Bit like just because you pull out infront of a speeding car doing 50 in a 30 the speed doesn't put liability on the toes of them.

It might also not be an insurance write off...might just be what the bloke has wrote...might of been self inflicted and just an assumption he's made.

Spose the only way would be to talk to him and check the v car register.

The Roro gear is whatll sell the truck.

My sister wrote off her car (into the scenery, no 3rd party cars involved) when drunk. She was arrested/charged etc. The insurance paid out for her car (ridiculously!), fully aware of all facts…
We had someone rear-end one of the vans (when tax disks were still a thing) and the first thing their loss adjuster did when inspecting our damage was check that the vehicle was taxed - not sure if that would be a ‘get-out-of-jail-free’ card for them but it has stuck with me since (whenever I’m driving something sorned 🤣)

Information....is the key ..or lack of it.
I killed an amarok in a lake District ford...off road.
Dragged it to the a590 and AA guy just wrote flood damage....insurance paid for a short engine no sweat 😘

Even got it recovered by VW assist for free 😃

ditto no MOT/tax / blatant MOT failure fault - should not be in use on the road - end of - uninsured
