Recently bought a JCB tracked barrow from a machinery dealer, after about 4 day’s use the final drives started pissing out oil. Been quoted £900 for a new drive motor and bearing on one side and a new bearing on the other. Currently waiting for the dealer to get back to me but just wondered where I stand.

He seems sound, said he needs to talk to his father and see what they can do.

The invoice doesn’t say anything about a warranty.

Been in similar situation before, it’s not like it’s 4 months or even 4 weeks, hope it comes good.

Legally I think you will find they are legally obligated to repair or replace but you need to give them a chance to do so themselves

Sold as seen etc means nothing in the used game if your a dealer your legal position is quite poor

Of corse you wouldn’t want to quote legal jargon and if it’s a dealer worth his salt he will repair it for you

I bought a tracked yanmar dumper one from auction it had low hours and we had sold one quickly before. I do my best not to buy from auctions because it’s usually junk but sometimes we have little choice

Sat on it for ages and in the end sold it for cost price to get it gone. A day later it was broken down I can’t remember the full details but even though it was a few years old it had been bodged for sale. There was no cooling fan they hydraulic pump shaft was buggerd.

I asked he customer to take it to a fitter that we use and I stomached £1100 for a repair. Because I was dammed if I did and dammed I’d i diddnt also I treat people how I would want to be treated. It’s one of them things and your reputation is what counts.

Fairly sure If it's under 30 days from purchasing you can ask for a refund or they can offer to repair it.

I know this is the case with cars,can't see it being any different with a machine.

No, I called him on Wednesday, he said he hadn’t had a chance to talk to his dad yet. Called him again on Friday and no answer so left a message. Starting to feel like he’s taking the piss. I’ll chase him up again after the weekend.

I’ve had it repaired, couldn’t have it sat doing nothing and I couldn’t sell it knowing it was knackered.

Just called him now, he still hasn’t talked to his dad, that’s been 2 weeks since I first called him. Says he doesn’t know what to do as he’s lost money on it already.
Starter motor is now hanging off and it’s running rough after it’s been running a while. Looks like I bought a lemon 🍋

Going to email him tonight with a timeline of events. Don’t know what good it will do though.

What’s it got to do with his dad, the guy needs to grow a pair.
s**t situation to be in, i had a problem with a used pickup years ago so I know how you must feel, if the twat hadn’t ignored my phone calls I would of split the bill 50/50 with him but in the end it cost him thousands but took 6 mouths to sort.

I’m really sorry to say but what they won or lost on it makes no difference it’s a sad story to hear how can he not have ‘talked to his dad’ in two weeks

It really gets my blood going to hear this as gives the trade a bad name just man up take some medicine (loss) and go again

As regy says he needs to take the loss on his chin and move on. No trader / dealer wakes up and thinks I'm gonna blow £500 but it's part of the job. You'll never make money on every deal but its the bigger picture.

Maybe if he'd of shaped in the first place you'd be coming on here saying you'd bought a pup but the dealer sorted you out and now you've bought another machine from him.

I’m not sure but I’m guessing his dad holds the purse strings. Getting more than a wee bit pissed off now.

Like I said to him I’ve now lost money on it. I would understand if it was a private sale through eBay or an auction, you take your chances with those. But the reason I bought from a trader was so I would have some kind of comeback.

That’s right Adam, it’s all part of business, swings and roundabouts. I’m sure he doesn’t complain if he makes too much money on a machine.
